WMPH Vacations (hereinafter referred to as "WMPH"), dba: iCruise.com provides its services to you, subject to the following terms of service. By your use of this Web Site and/or services provided to you by ACCESSING, BROWSING AND/OR USING OUR WEBSITE AND/OR SERVICES ON OUR WEBSITE AND/OR OUR CALL SERVICE CENTER, YOU ARE DEEMED TO ACCEPT THESE TERMS OF USE AND AGREE TO BE BOUND BY THIS AGREEMENT WITH RESPECT TO THE USE OF OUR WEBSITE AND/OR CALL SERVICE CENTER. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, PLEASE DO NOT ACCESS, BROWSE, USE OUR WEBSITE AND/OR CALL SERVICE CENTER OR ANY SERVICES WE PROVIDE. We may make changes to these terms and conditions at our sole discretion from time to time. Your continued use of the site and/or our call center following these changes constitutes your acceptance of these changes.

Ownership

This Web Site is the copyrighted property of iCruise.com and/or its various third party providers and distributors. All information, including and without limitation to, text, graphics, software and all HTML, metatags, CGI and other codes and scripts in any format used to implement the Web Site ("Content") are the property of WMPH and/or its third party providers and distributors.
WMPH and iCruise.com has identified and cataloged all original content and our original variations and modifications of third party content, text, graphics, software and all HTML, metatags, CGI and other codes and scripts This content and other content on the Web Site is for personal use only. You may not copy, modify, download, upload, transmit (republish or otherwise distribute any content from the Web Site except as expressly permitted by these terms and conditions. Doing so will violate iCruise.com's copyright, trademark and other proprietary rights and the person, persons, company or entity in violation agrees to pay WMPH and iCruise.com a fee of $10,000 per each page of iCruise.com's original or modified content, HTML, metatags, CGI and other codes and scripts or partial page of content used in violation of this agreement and will further, immediately cease and desist using the content upon receipt of written notice from WMPH Incorporated. Nothing contained in the Terms and Conditions shall be deemed to give you any rights in or to any Trademarks, potential trademarks or copyrights of WMPH and iCruise.com.

Limitations of Responsibility

iCruise.com provides users with the access to a rich collection of on-line resources, including, various information tools and product specific information provided by third parties. You understand and agree that the service is provided "as is" and that iCruise.com assumes no responsibility for the descriptions, availability or misquotations of offers and programs provided by the supplier or their agents.

iCruise.com sells vacation travel provided by third parties that iCruise.com does not control. iCruise.com is not responsible for breach of contract or any intentional or negligent action on the part of such third party suppliers which may result in loss, damage, delay or injury to you or your travel companions. iCruise.com does not guarantee any of our third party suppliers' rates, bookings, reservations, connections, scheduling or protection of personal belongings. In addition, iCruise.com assumes no responsibility for overbooking, cancellation or delays for cruises, hotels or airlines, tour operators, ground transportation or other providers of service.

iCruise.com shall not be responsible for any damage to or loss of luggage or personal items. We highly recommend the purchase of travel insurance. Travelers who use this Web Site or our call center, assume full responsibility for, and hereby release iCruise.com from any duty of checking or verifying any passports, visa, vaccination or other entry requirements for chosen destinations. The traveler agrees that iCruise.com is not responsible for any potential risks and hazards associated with travel to destinations listed on the Web Site. By embarking on travel arrangements through, or utilizing information contained on, the Web Site, you voluntarily assume the risks associated with such travel.

WMPH PACKAGE RESERVATIONS

WMPH Packages are designed to include multiple travel suppliers at a single price. Travel suppliers can include but are not limited to: airlines, cruise lines, hotels, transportation companies, tour operators, shore excursion providers and resorts (See the section: Limitation of Responsibility above)

Online Reservations: Completing the online reservation form does not guarantee a reservation. WMPH Vacations will make every effort to book the sailing date and categories requested. WMPH Vacations will contact you with stateroom category, rates and availability of your sailing date prior to charging your credit card.

Pricing: All prices listed were current at the time the rates were loaded on the website and are subject to change without notice. A per person deposit is required to confirm a reservation. Prices do not include non-commissionable fees, additional service charges or travel insurance. Surcharges or fees such as a fuel surcharge implemented by a travel supplier even after the reservation is made are the responsibility of the traveler. Cancellation Policy: Loss of deposit after booking. Final payment is required 90 days prior to travel unless otherwise specified in writing. For most Packages, cancellation after final payment is as follows: 90 to 50 days prior to travel – 50%; 49 to 35 days prior to travel – 75%; within 35 days – non refundable.

Revisions: Travelers may request but WMPH cannot guarantee revisions including, but not limited to, name changes, choice of travel dates, cabin or room categories, or travel supplier preferences. If a revision request can be accommodated, you are subject to a $35 revision fee plus any penalties imposed by the travel supplier. WMPH reserves the right to substitute any service or travel supplier with one of similar or equal quality. Documents: You will receive your travel itinerary and any required documents via e-mail approximately seven (7) to fourteen (14) days prior to travel. Documents that are required to be shipped to a country outside of the U.S will be subject to the shipping costs that apply.

Air Arrangements: If WMPH is making your arrangements, flights will be scheduled for the scheduled arrival and departure days as indicated on the Package itinerary. If you wish to travel on dates other than these dates, you MUST request this at the time you make the reservation. For Packages that include airfare, you can expect the following:

WMPH uses commercial airlines, travel websites as well as commuter and/or charter air service. These tickets are highly restrictive and almost always non-refundable.
WMPH cannot guarantee a specific flight schedule in advance. Should you desire a specific air schedule in advance, an air deviation fee of $50 per ticket will be charged in addition to the fare difference, if any.
Flights travelling west to east may be red-eye flights. In most cases, no more than one connecting flight will be utilized. Delivery of your flight schedule will occur via email 21 to 45 days prior to departure.
WMPH is not responsible for seat assignments, special meal requests, or other airline policies. The guest must address these with the airline directly. Depending on the airport (usually international airports), you may be responsible for airport departure or facility fees or other taxes/fees/surcharges assessed by the airport or foreign government agency.
The client is responsible to ensure they have the proper identification to travel with both the airline and the cruise line.

Travel Insurance: WMPH HIGHLY RECOMMENDS THE PURCHASE OF TRAVEL INSURANCE. Travel insurance will not be activated until it is paid for and confirmation has been received from the travel insurance provider. Travel insurance can be paid at the time of deposit but must be paid at the time of final payment. WMPH will automatically include travel insurance on your invoice. Unless WMPH receives written notice of your decision to decline travel insurance, WMPH will charge your credit card for this product at the time of final payment.

Limitation of Liability

CRUISECHEAP.COM ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR BROWSING IN THIS WEB SITE OR YOUR DOWNLOADING OF ANY MATERIALS, DATA, TEXT, IMAGES, VIDEO OR AUDIO FROM THIS WEB SITE. IN NO EVENT SHALL CRUISES-N-MORE OR ANY THIRD-PARTY PROVIDERS AND DISTRIBUTORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (A) ANY USE OF THIS WEB SITE OR CONTENT FOUND HEREIN, (B) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE FOR RESERVATIONS OR TICKETING) OR (C) THE PERFORMANCE OR NON PERFORMANCE BY iCruise.com OR ANY THIRD-PARTY PROVIDERS AND DISTRIBUTORS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY.

Indemnification

You agree to defend, indemnify and hold harmless iCruise.com and any third-party providers and distributors and their officers, directors, employees and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described herein or by third parties as a result of your use of this Web Site.

Governing Law

The laws of the State of Florida, United States of America, shall govern this Agreement and its performance. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Palm Beach County, Florida, United States of America, in all questions and controversies arising out of or related to your use of the Web Site and this Agreement.

Links to Other Web Sites

This Web Site may contain links to other Web sites. These links are provided solely as a convenience to you and are not endorsed by iCruise.com and/or its third-party providers or distributors. iCruise.com and/or its third-party providers or distributors shall not be responsible for the content of any other Web sites and make no representation or warranty regarding any other Web sites or the contents or materials on such Web sites. If you decide to access other Web sites, you do so at your own risk.

Severability

These Terms and Conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Modification of These Terms and Conditions

iCruise.com reserves the right to change the terms, conditions, and notices under which this Web Site is offered.

Entire Agreement

These Terms and Conditions constitute the entire Agreement between you and iCruise.com relating to your use of the Web Site, at any time and in any way, and supersede any prior understandings or agreements between you and iCruise.com relating to such use, whether electronic, oral, or written.

Important Information Regarding Cruise Reservations

PASSENGER NAMES
The spelling of names on your invoice must match the Proof of Citizenship you will be using to travel. If the name or spelling is incorrect, please contact us immediately. Service charges incurred by the cruise line for correcting these are the passenger’s responsibility.

TRAVEL DOCUMENTS
Will be sent as soon as we receive them from the cruise line, and normally outside of 7 days prior to departure.

PROOF OF CITIZENSHIP
Proper Identification is REQUIRED to Travel – A passport is recommended (and easiest) for all travel. For some cruises, a certified birth certificate and photo ID may be acceptable. The cruise line may deny boarding if you do not carry proof of citizenship, or a passport where required. Please verify your identification prior to sailing. It is the responsibility of the passenger(s) to be aware of the proper documentation required for travel to various countries. If you are denied boarding because you do not have proper identification and documentation to travel, neither iCruise.com nor WMPH Incorporated is responsible.

TRAVEL PROTECTIONS / TRIP CANCELLATION INSURANCE
We highly recommend you purchase travel protection / trip cancellation insurance at the time you make your reservation. If this invoice indicates the cost of travel insurance not yet purchased, you may purchase this coverage anytime prior to or with your final payment; if you wish to decline coverage, please contact us. If this invoice indicates zero cost for travel insurance, you hereby agree to decline such coverage and to hold neither iCruise.com nor WMPH Incorporated responsible for any additional expenses incurred due to travel delays or cancellations. CANCELLATIONS, NAME CHANGES, PENALTIES
In addition to cruise line or travel supplier cancellation penalties, a fee of $50 per person will be charged to all cancelled reservations. Name changes are subject to the current cruise line policy and penalty.

AIR POLICY AND DISCLAIMER
Airfare reserved through the cruise line is subject to their scheduling. Your schedule and routing will be completed by the cruise line and available approximately 30-45 days prior to travel. Frequent flyer mileage programs, airline seat selection, and special requests are solely the responsibility of the traveler in accordance with airline policies. Our company has no control over air carrier, seat assignments, scheduling, routing, or delays. If you have special needs or preferences, we strongly recommend you make custom air arrangements.

CUSTOM AIR ARRANGEMENTS
For an additional charge, we can make a request with the cruise line for a specific airline, schedule, routing, or other deviation from scheduled travel dates. The minimum service charge of $35-$50 per person applies in addition to the cruise line service charge and fare differentials. This service charge is non-refundable. Requests cannot be processed within 60 days of departure. Please call us to customize your air schedule.

RESPONSIBILITY
Neither iCruise.com nor WMPH shall not be liable for any loss, damage, injury, illness, death, cost or delay arising from or in connection with the services and facilities provided by or any act of a supplier such as cruise line, airline, rail, hotel, tour, or any other transport operator, etc., whether or not such arrangements were made by iCruise.com or WMPH.

We reserve the right to correct clerical errors on the invoice, including but not limited to taxes, government fees, air and cruise charges, and miscellaneous costs any time up to commencement of travel. Additionally, cruise lines may increase government taxes and fees, or a fuel surcharge may be imposed by the cruise line or government agency. These additional costs, if any, will be the sole responsibility of the traveler. Any additional expenses incurred because of travel delays will be the responsibility of the passenger. We strongly recommend travel protection insurance to cover the cost of travel delay and trip interruption.
